Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

  • Application means the DaliaHealth software program provided by the Company, available for download on iOS (Apple App Store) and Android (Google Play Store) mobile devices.

  • Health Data means any data related to Your physical health that is collected through the Application or DaliaHealth devices, including but not limited to heart rate, heart rhythm, blood pressure, oxygen saturation, audio recordings from stethoscope devices, and any AI-generated health analysis or insights derived from such data.

  • Personal Data is any information that relates to an identified or identifiable individual.

  • Service refers to the Application, the Website, and any DaliaHealth hardware devices used in connection with the Application.

  • Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.

  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

  • Website refers to StethoAI, accessible from daliahealth.com

  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:

Usage Data is collected automatically when using the Service.

Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.

We may also collect information that Your browser sends whenever You visit our Service or when You access the Service by or through a mobile device.

Health Data

When You use the DaliaHealth Application and compatible devices, We collect Health Data to provide You with health monitoring and analysis services. The types of Health Data We collect include:

Cardiovascular & Vital Signs:

  • Heart rate measurements and heart rhythm patterns

  • Blood pressure readings (systolic and diastolic)

  • Blood oxygen saturation (SpO2) levels

  • Heart rate variability (HRV) metrics including SDNN, RMSSD, PNN50, and LF/HF ratio

  • Respiratory rate measurements

  • Stress level and energy level assessments

Audio & Video Recordings:

  • Heart and lung sound recordings captured through StethoAI stethoscope devices via microphone

  • PPG (photoplethysmography) video recordings captured via camera for VitalTouch heart rate measurement

Metabolic & Glucose Data:

  • Blood glucose readings and glucose type

  • Insulin dosage and insulin type

  • Carbohydrate intake related to glucose management

Activity & Lifestyle Data:

  • Step count and daily activity levels

  • Active calories burned

  • Exercise and workout data (type, duration, pace, calories)

  • Sleep duration and sleep stage analysis (awake, REM, light, deep sleep)

  • Body weight measurements

  • Water/hydration intake

Nutrition & Food Data:

  • Food and meal photographs captured via camera for AI nutritional analysis

  • Calorie, protein, carbohydrate, and fat intake

  • Detailed nutritional information (fiber, sugar, sodium, vitamins, minerals)

  • Meal history and nutrition goals

AI-Generated Health Insights:

  • Heart murmur detection and irregular heartbeat analysis

  • Health scores and risk assessments

  • Personalized health recommendations

  • Nutritional analysis from food photos

Health Platform Integration (with Your permission):

  • Apple HealthKit data (iOS): We may read and sync health data from Apple Health including steps, blood pressure, blood glucose, oxygen saturation, sleep, weight, water intake, and active calories

  • Health Connect data (Android): We may read and sync health data from Health Connect including steps, blood pressure, blood glucose, oxygen saturation, sleep, weight, hydration, and active calories burned

Device & Measurement Data:

  • DaliaHealth device pairing information (StethoAI, DaliaSense) via Bluetooth

  • External health device readings (blood pressure monitors, pulse oximeters, glucose meters)

  • Measurement timestamps and historical records

Health Data is collected when You actively use the Application features, pair compatible devices, or grant permission to sync from Apple HealthKit or Health Connect. We access Your camera for VitalTouch PPG readings and food photo analysis, and Your microphone for stethoscope recordings, only when You initiate these features.

Tracking Technologies and Cookies

We use Cookies and similar tracking technologies to track the activity on Our Service and store certain information. Tracking technologies used are beacons, tags, and scripts to collect and track information and to improve and analyze Our Service. The technologies We use may include:

  • Cookies or Browser Cookies. A cookie is a small file placed on Your Device. You can instruct Your browser to refuse all Cookies or to indicate when a Cookie is being sent. However, if You do not accept Cookies, You may not be able to use some parts of our Service. Unless you have adjusted Your browser setting so that it will refuse Cookies, our Service may use Cookies.
  • Web Beacons. Analytics and Advertising

We use analytics services to understand how You use our Application and to improve our services:

Firebase Analytics

We use Firebase Analytics (provided by Google) to collect information about Your use of the Application, including:

  • App opens and session duration
  • Feature usage (which screens You visit, which features You use)
  • User actions (login, signup, measurement completion)
  • Subscription and purchase events
  • Error and crash reports
  • Device type, operating system, and app version

Firebase Analytics may use Your Firebase User ID to associate usage data with Your account. This helps Us understand how users interact with our Application and identify areas for improvement.

Advertising

Our iOS Application may include advertising functionality through Google AdMob. This service may collect:

  • Advertising identifiers (IDFA on iOS)
  • Device information for ad targeting
  • Ad interaction data

You can opt out of personalized advertising through Your device settings. On iOS, go to Settings > Privacy > Tracking to manage ad tracking preferences. We do NOT use Your Health Data for advertising purposes.

Push Notifications

We use Firebase Cloud Messaging (FCM) to send You push notifications. To enable this feature, We collect:

  • Device tokens (FCM tokens on Android, APNs tokens on iOS)
  • Notification preferences

Push notifications may be used for:

  • Health measurement reminders
  • Important health alerts and insights
  • App updates and new feature announcements
  • Subscription and account notifications

You can disable push notifications at any time through Your device settings or within the Application.

Use of Your Personal Data

The Company may use Personal Data for the following purposes:

  • To provide and maintain our Service, including to monitor the usage of our Service.

  • To manage Your Account: to manage Your registration as a user of the Service. The Personal Data You provide can give You access to different functionalities of the Service that are available to You as a registered user.

  • For the performance of a contract: the development, compliance and undertaking of the purchase contract for the products, items or services You have purchased or of any other contract with Us through the Service.

Use of Your Health Data

Your Health Data is particularly sensitive, and We take special care in how We use it. The Company uses Your Health Data for the following specific purposes:

  • To Provide Health Monitoring Services: We use Your Health Data to deliver the core functionality of the DaliaHealth Application, including displaying Your health measurements, tracking trends over time, and generating health reports.

  • To Generate AI-Powered Health Insights: Your Health Data is processed by our artificial intelligence algorithms to provide You with personalized health analysis, detect potential irregularities, and offer health recommendations. These insights are intended for informational purposes and are not a substitute for professional medical advice.

  • To Store Your Health History: We securely store Your Health Data to maintain a comprehensive history of Your health measurements, allowing You to track Your health over time and share this information with healthcare providers if You choose.

  • To Improve Our Services: We may use anonymized and aggregated Health Data to improve our AI algorithms, enhance the accuracy of our health analysis, and develop new features. This data cannot be used to identify You personally.

  • To Provide Customer Support: With Your explicit consent, our support team may access Your Health Data to help troubleshoot issues or answer questions about Your measurements.

We do NOT use Your Health Data for advertising purposes or sell Your Health Data to third parties under any circumstances.

Sharing of Your Health Data

We understand the sensitive nature of Health Data and strictly limit how it is shared:

  • We Do Not Sell Your Health Data: Under no circumstances do We sell, rent, or trade Your Health Data to third parties for their marketing or commercial purposes.

  • With Your Healthcare Providers: You may choose to share Your Health Data with Your doctors or healthcare providers through export features in the Application. This sharing is always initiated by You and under Your control.

  • With Service Providers: We may share Health Data with trusted service providers who assist in operating our Application (such as cloud storage providers). These providers are contractually obligated to protect Your data and may only use it to provide services to Us.

  • For Research Purposes: With Your explicit consent, anonymized and de-identified Health Data may be used for medical research to advance health outcomes. You can opt out of research participation at any time through the Application settings.

  • Legal Requirements: We may disclose Health Data if required by law, such as in response to a valid court order or subpoena, or to protect the safety of individuals.

Retention of Your Personal Data and Health Data

The Company will retain Your Personal Data and Health Data only for as long as is necessary for the purposes set out in this Privacy Policy.

Health Data Retention

Your Health Data is retained for as long as Your account remains active, allowing You to:

  • Access Your complete health measurement history
  • Track health trends over time
  • Share historical data with healthcare providers

You may delete Your Health Data at any time through the Application settings or by requesting account deletion. Upon account deletion, Your Health Data will be permanently removed within 30 days, except where retention is required by law.

Personal Data Retention

We will retain and use Your Personal Data to the extent necessary to:

  • Provide our Services to You
  • Comply with our legal obligations
  • Resolve disputes
  • Enforce our legal agreements and policies

Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.

Transfer of Your Personal Data

Your information, including Personal Data, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. Delete Your Personal Data and Health Data

You have the right to delete or request that We assist in deleting the Personal Data and Health Data that We have collected about You.

Deleting Health Data Within the App

The DaliaHealth Application provides You with the ability to delete Your Health Data directly:

  • Delete individual health readings or measurements
  • Delete Your entire measurement history
  • Remove specific data categories (e.g., blood pressure readings, heart recordings)
  • Clear device pairing history

To delete data within the app, navigate to Settings > Privacy & Data in the Application.

Deleting Your Account

To permanently delete Your account and all associated Personal Data and Health Data, please contact Us by email at info@daliahealth.com with the subject line "Account Deletion Request."

Upon receiving Your request, We will:

  • Verify Your identity to protect Your account
  • Process Your deletion request within 30 days
  • Permanently delete Your account, Personal Data, and Health Data from our systems
  • Send You a confirmation email once deletion is complete

Please note that once deleted, Your data cannot be recovered. We may need to retain certain information when we have a legal obligation or lawful basis to do so, but any retained data will be anonymized where possible.

Disclosure of Your Personal Data

Business Transactions

If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.

Children's Privacy

Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 13 without verification of parental consent, We take steps to remove that information from Our servers.
